TPAR Compliance for Australian Contractors: What You Need to Know in 2026
The Taxable Payments Annual Report (TPAR) is not optional. If you operate in construction, cleaning, courier, IT, security, or road freight and you pay contractors for services, you must lodge a TPAR with the ATO every year. In 2025, the ATO issued over $18 million in penalties to more than 11,000 businesses for non-compliance.
What Is TPAR?
TPAR requires businesses in certain industries to report all payments made to contractors for services. The ATO uses this data to identify contractors who may not be reporting their income correctly. If a contractor cannot provide an ABN, you must withhold 47% of the payment.
Who Needs to Lodge TPAR?
You must lodge a TPAR if your business:
- Operates in construction, cleaning, courier, IT, security, or road freight
- Pays contractors for services (not just goods)
- Has an ABN
This applies to businesses of all sizes — there is no revenue threshold.
TPAR Penalties
| Violation | Penalty |
|---|---|
| Failure to lodge TPAR | $313 to $1,500+ per statement |
| Significant global entity | Up to $825,000 |
| Failure to withhold (no ABN) | You become liable for the 47% withholding amount |
Documents to Collect from Every Subcontractor
Before making payments, you should have on file:
- ABN verification — verify via ATO ABN Lookup at onboarding and periodically
- Workers Compensation Certificate of Currency — NSW Section 175B requires this before payments
- State contractor/trade licence — NSW Fair Trading, QBCC, or VBA as applicable
- Public Liability Insurance certificate — typically $5M-$20M cover
- Subcontractor Statement (NSW) — required with each payment
